The OP was updated to state information that has come to light. The Engineering Sample that I had was a 945 BE (ES) AM3 chip and not a 940 BE like originally thought.

How did you find out it was a 945BE?

Well the first thing was the guy that I got it from was told it was a 945 (ES) when he received it. When I received it they guy I had gotten it from had already posted some info on various forums about the chip and everyone was telling him it was not a 945, but they didn't have one so how would they know. Then the 940's were released and I asked someone to look at a picture of my chip and then look at their chip and tell me if the pins were the same and they said they were. So after I played with it awhile I decided I wanted to get a retail chip to see if they were any better. When I received my retail chip (and of course I had already sent my ES off) I looked at the pins and sure enough the pins were different. I also noticed that on the retail chips the HT and NB clocks were at 1800MHz however on the ES they ere both 2000MHz which I am pretty sure what the 945 is supposed to be. Finally after seeing some discussions on XS about some of the chips they got to play with at some of the events AMD hosted it seems they were using 945 chips as well and one was pictured and it had the same pins. Finally after seeing a MB socket for the AM3 chips that was the final confirmation I needed.

man, that blows. WELL, at least we know the 945's overclock pretty well.
