Default windows 7 upgrade help. microsoft cant

i tried calling microsoft and they were useless. here is my problem. i am building a new system and have a new HDD. i can get windows 7 upgrade for 30 dollars because i am a student. the 7 upgrade will only work if there is windows on the hdd already. i dont have a copy of any other windows anymore. what can i do?

another thing is i have a hdd with windows xp on it that will not boot into windows in my older system from 4 years ago. i dont know if its hardware or software problem so i am going to try in new system. if i try to install windows 7 upgrade on this one it will work however it is a 80gb hdd that is older so i dont want to use it as my drive in my new computer. is there a way i am going to be able to transfer windows 7 to the new hdd?

if i get 7 upgrade to install on the older drive that has xp on it and i call microsoft and explain i am getting a new hdd will they give me a key that will let me use the 7 upgrade on a new hdd?

what if i get 7 on the older hdd can i just run windows off that and use the new drive for everything else? i never ran 2 hdd in 1 computer.

any ideas or suggestions would be great. i realy hope i dont have to buy 7 retail for 200 bucks.

Windows liscencing is nuts.

As paul thurrott states, just about everyone owns a windows liscence, and is eligable to upgrade, BUT, for instance, an oem copy of xp is meant only for that machine, so if you install it on a new machine, you technically dont have a liscenece for that particular machine, and should have bought the full version.

So if its a new build you legally shouldn't install it onto that machine,

if its the build with xp installed and you got a bigger hdd, for it, you could first install windows 7 over the xp, then use a cloning program to clone the 80gig onto your bigger hdd and keep it in the same pc, to stay "legal"

With that said, you could just do what pual said in that writeup linked above me. and it wont matter because microsoft wont find your and arrest you for that petty of a "crime"

i just read that article right before i came back to this site. i will try the double install method see how that goes. thanks for the help. i am sure one of those will work.

THIS is how I did it myself, on both my laptop and main computer:

To start with, make sure your downloaded Windows 7 files (the 'expandedSetup' directory) is unzipped into C:\ -- it'll make things easier later.

1. Download this tool -- alternatively you can obtain the official pack from Microsoft, but that's a whole darn gigabyte.

2. Unzip and move oscdimg.exe to your System32 directory (likely to be C:\Windows\System32)

3. Open an elevated command prompt. In Vista you do this by typing 'cmd' into your 'Start Menu' and hitting ctrl+shift+enter. In XP, just type 'cmd' into the Run dialogue (Windows Key+R or from your Start Menu).

4. Type (or copy and paste) the following into your command prompt (this will vary a little, depending on where you've put your expandedSetup folder):

oscdimg.exe -u2 -b"C:\expandedSetup\boot\etfsboot.com" -h "C:\expandedSetup" C:\WIN7.ISO

5. Ta'da! You've got a burnable ISO!

All you need to finish the job is a good burning application like ImgBurn, CDBurnerXP, or InfraRecorder. For this particular task I'd recommend ImgBurn - then just right click the ISO file and start the burn from your context menu. Or launch ImgBurn and choose "write image file to disc" -- your choice!
You don't have to have a copy already installed. The key you get from 741 will act just like a regular key- perform a fresh install off the disc you make using what I posted, and then just use the key 741 gives you and you should be fine.

sorry i did not know where to post this topic at. where is the best spot to post something like this for future reference?

thanks for that link. i thought i would be downloading a iso file and i was going to use the program microsoft put out to make it bootable from my flash drive. i did not realize it had to be turned into an iso first. once it is a iso can i use microsofts program or should i use the one they list at the end?

so the key they give for the win741 will work on a new hdd? thats cool i did not think it was the upgrade at first then i went to buy and download and i saw it was the upgrade only. the rest of my system is not going to be here until monday so i will try all of this then and i really hope it works.

I thought that the Win7 upgrade only worked for vista, and not XP . I also didn't think that an upgrade pack was the full OS.
Should of bought OEM or the retail pack.

i just did this from the instructions listed in the post about making an iso.

i have an iso and it is bootable on a usb drive(i hope). now i have to hope i can activate using the upgrade key from win741. i have read on other forums that if you call microsoft store they will sell you the full version for 30 bucks not the upgrade that is available through digital rivers win741 store. i wish i knew this before i bought it from them...

either way one of the ways listed in the article from the first post has to work.
