bios flashing will void your warranty. thats got nothing to do with software overclocking.
have you ever flashed your motherboard bios? its like doing that but to your gpu and using a non supported bios.

I haven't flashed my mobo yet. So I dont need to worry about flashing. So It looks like everyone is using either the msi one or the asus one? Is it hard to overclock and what temps should I be in at load? How do I test if my card is stable?

The 5850 with clocks of 950/1250 would put it and the 5870 very close.

I'm not sure about the max/safe load temps but the lower the better. Also you could use Furmark or ATi tool to test your overclock on your gpu.

They flash bios only to get above limited OC, there is no other point of doin it. Would be nice to see 5850 level with 5870, I will grab some drink and see hows is done

Is it worth it and safe enough to keep the card oced 24/7? Any ideas? Does this 5850 have the feature that if it is not in use that it will save energy and stay low temp?

Yes it will be safe as long as the voltage and temps are ok. Yes it does I'm not sure if it will work if you use any other program other than ATi CCC to overclock your card. You just need to test it out.
If your gonna overclock your 5850 to the clocks of a 5870 you will definatly need to increase the voltage to your card, You can use msi afterburner to do that. You will be able to figure out how much you need to raise it by testing the card with Furmark or ATi Tools to see if you get artifacts.
