Yeah it's dying, you might try ghosting it to another drive with force clone on, or recover the data with EasyRecovery.

:/ Well I think you might be up the creek there buddy... You can always test it with Easy Recovery Pro 6 that comes with AdminTools.
If it fails that, it's going.

IS windows reporting this?
Did it say anything about a delayed write failure? Anyway - for starters. go to run prompt, type CMD, and when the prompt comes up. Type in chkdsk /r /f C: (where C is the name of the drive in trouble..) -lets just hope you're drive has developed some magnetic bad sectors..

the drive says RAPTOR and yet its a maxtor? whats going on here?
lol sorry. i couldnt resist. Anyway... see if you can load up speedfan onto another drive and access the SMART error reporting service and see if it fails SMART. If its a mechanical error, you will need to buy a new drive. This is why I keep a $100 bill in my drawer, in case of these kinds of emergencies.

That drive is a goner. Weird that Maxtor refuses to rma it. Especially since Maxtor has been taken over by Seagate. Had a 80 gb Maxtor that just ceised to work and after a bit of mailing back and forth with Seagate they send me a refurbished 80 Gb drive. The drive that stopped working was a 2001 batch and they told me i had warranty till 2009 on that drive.
__________________Maybe it's worth trying to contact Maxtor/Seagate customer service again. That is if the drive is not to old e.g. past warranty.

If you're interested, I could upload an .ISO of the AdminTools program to my server, and you could use that to test your HDD.
I find it VERY good at finding bad hard drives, as it is what we use here at work.
