Default [TechCrunch]Verizon Pays ASCAP $5M Interim License Fee For … Ringtones

Quote:
The American Society of Composers, Authors, and Publishers (ASCAP) recently made the ridiculous assertion that cellphone ringtones are to be considered “public performances” of music under the Copyright Act and thus require a license...

Even the Electronic Frontier Foundation (EFF) sided with the defendants in the case (AT&T and Verizon Wireless), called the organization’s claims downright ‘outlandish’ and urged a federal court to reject the “bogus” copyright claims.

Often times I don't like to wish harm to others but I hope whom ever is responsible for coming up with such a claim be shot.

So, do any of you folks who just posted have a useful opinion?

This seems like a perfectly legitimate claim to me - unlike the RIAA, the ASCAP represents just as many "little guys" as big names. It's actually a good organization. Whether my cell phone plays the music in public, or I set up a PA to do it, its a public performance.

I find people's ringtones to be some of the most obnoxious sounds ever. So while in reality I could care less about this, part of me is happy that people might actually have to shell out more money for the latest crap pop song to be their boyfriend's ringtone.

Yes, because we all know ringtones, when played, are meant for public entertainment...

Edit:
So if that logic applies then I guess playing music in your car counts as a public performance as well.

But you have bought those songs, or radio stations have the rights to air those songs coming from your car.

I assume.

if someone else can hear it I guess.

and its not the case that everyone has bought the songs they listen to in their cars. It's also not the case that they were pirated either. think what NIN has done.
