I got my E8400 up to 4.0 with temps only around 40*C according to realtemp and cant go any higher cuz my VCore is already at its max...

1.36 is the max VCore before vdroop for these right?

I can get well over 4.0 with a higher voltage but itll ruin my chip?

What if its 1.36 after VDroop and 1.38 before vdoop will that still be bad?

4.0 is the max I would run that 24\7, but I would go higher to run some benches.

Your chip seems to have hit its wall, so I would lower the OC a little (maybe 3.8).
