Exclamation For Sale / Wanted Section Rules [To be revised for new Market format]

Please read and understand these rules before posting in the For Sale / Wanted section. These rules supersede all previously posted rules and are part of the Terms of Service of Overclock.net.

1. To post a new thread in the For Sale and Wanted Forums you must have at least 35 REPs. The reason for the limit is so the other members know that a trusted member is selling parts, not just someone who stopped in here to get rid of junk. This rule has been frequently debated and will not change as it is here for your protection. It is not necessary to have 35 REPs to reply to For Sale or Wanted threads, though all members are encouraged to make deals only with other members they are comfortable with. This requirement is coded into the system, and exceptions cannot and will not be made. In accordance with the TOS, members who do not meet the rep requirement may not post such threads anywhere on the site.

2. No affiliate links are allowed. As a general rule, if you will benefit from the link you provide, it is not acceptable. You may post links to good deals in the Online Deals forum so long as you do not directly benefit from them. If you have any questions, please ask prior to posting. If the directors have questions, they will delete first and ask questions later.

3. This section may be used only for computer systems, components, software, and related items. "Tech toys" such as mp3 players are also permissible. Any For Sale / Wanted threads for items not listed above will be deleted, and services such as volt modding may not be offered. If you have any questions about the permissibility of your item, please PM Taeric or The Duke. Sellers must have the item(s) in hand prior to posting them for sale here.

The following types of software sales and software accounts are prohibited in For Sale/Trade/Wanted/Freebie/Appraisal in Threads or Posts in any way shape or form at overclock.net
  • Sale/Trade/Wanted/Freebie of OEM software: Unless it's in the original, factory sealed package or never registered AND accompanied by a significant piece of hardware (defined as optical drive or larger). EXCEPT: Open OEM registered versions of Windows may be sold with the motherboard the OEM license is tied to.
  • Sale/Trade/Wanted Freebie of online accounts unless sellers can demonstrate that the EULA does not prohibit sales (see known exclusions below)
  • Sale/Trade/Wanted/Freebie of software keys not accompanied by media and/or documentation
  • Sale/Trade/Wanted/Freebie of OEM software like promotional games that come with a video card, or similar OEM with "Not for Resale"
  • Sale/Trade/Wanted/Freebie of OEM software MUST be pictured and clearly readable to display whether the "Not for Resale" or the likes of 'Promotional Only' can be seen and determined where as "Not for Resale" or 'Promotional Only" can NOT be sold here.
  • No MSDN ebay accounts may be posted For Sale, Trade, Wanted or Freebie.
  • The STEAM EULA agreement states you may not Sell or Giveaway yours or another persons STEAM ACCOUNT. http://store.steampowered.com/subscriber_agreement/It's allowed here provided the game meets all the requirements. Can I Gift games I no longer play to my friends? You can not gift games that were previously purchased on your Steam account to friends.
  • Steam Orange Box: Half-Life 2 and Half-Life 2: Episode One can be gifted when purchased as part of the Orange Box package. For more information about Orange Box gifting, please see this guide.
  • Direct2Drive: "You may not assign or transfer your subscription to any other person or entity." http://corp.ign.com/user-agreement.htm
  • AION: You may not (a) sublicense, rent, lease, loan or otherwise transfer the Software or the Service" http://us.ncsoft.com/en/legal/user-a...agreement.html
  • Any service like Steam, AION, Direct2Drive etc... software is not allowed to be resold here with the limited exception of the STEAM Orange Box as in the a fore mentioned.
  • Modded XBOX: Any modification whether they be hardware or software that violate Microsoft's EULA can not be sole here.
4. EBAY or any auction site: Cross posting on eBay or any auction site is not permitted. Threads containing items listed on eBay or any auction site will be closed.

5. PayPal: NO fees, Credit Card or other with the exception of shipping and handling may be assessed and NO gift payments are allowed.
  • This includes, but is not limited to, charging extra or making the buyer cover PayPal service fees on credit card based PayPal payments. As we wish to comply as closely as possible with PayPal's guidelines, we will not allow any member to impose an extra "tax" for CC-based PayPal payments. "You agree that you will not impose a surcharge or any other fee for accepting PayPal as a payment method."
  • For your convenience, here is the excerpted section from the User Agreement. You may not request or offer a 'gift' or 'personal payment(s) to circumvent the associated fees.This will negate any possible paypal claim!
  • 4.2 Receiving Payments for Commercial Transactions and Personal Transactions.
  • 1a. Fees depend on whether you are making a commercial transaction or a personal transaction. A commercial transaction involves buying and selling goods or services, and payments received when you send a “request money” using PayPal. A personal transaction involves sending money to and receiving money from friends and family without making a purchase.
  • 1b. If you are selling goods or services, you may not ask the buyer to send you a personal payment for the purchase. If you do so, PayPal may remove your ability to accept personal payments.
6. Asking price must be included in all For Sale threads.
  • 1a. For Sale threads that do not include asking price will be locked until the seller sets an asking price. As this is not an auction site, sellers may not raise their price once the asking price is offered. It is the responsibility of the seller to determine the exchange rate if the transaction includes multiple currencies.
  • 1b. ''TRADE'' only thread/item(s) do not require an asking price as it's not being offered as ''For Sale.''
7. Although it is not required, it is strongly suggested that For Sale threads include a photograph of the actual item(s) for sale as well as a note with your Overclock.net name, the date, and a valid e-mail address.

8. Seller may list multiple items in a single thread. To do so, sellers must follow these additional rules:
  • Item must conform to the "Allowed Item' per the section
  • Each item or group of bundled items must be numbered
  • Each numbered line must have an asking price
  • Upon completion of a successful sale, items should be marked SOLD. Sold items are not to be deleted from For Sale threads as this makes the buyer/seller feedback system confusing.
  • The seller must maintain the original post according to these rules or it will be removed
9. All offers are to made using the Private Messaging system. If you do not have enough reps to use the PM system, PM a director, and the message will be forwarded to the seller. Offers made in the body of a sale thread will be deleted.

10. Posts are only to be for obtaining product information about the listed products. Price is not to be discussed in the body of the thread except by the seller (asking price is required in the first post and may be updated in later posts). All posts that do not follow this rule will be deleted. Thread bashing and off topic posts will result in infractions. A second offense will result in the loss of For Sale / Wanted Section privileges for a month, and a third offense will result in an permanent loss of For Sale / Wanted Section privileges.

11. Do not post an item unless you are definite that you want to sell it.

12. If you are looking to purchase an item, post the exact item that you are interested in obtaining.

13. When your item sold or you have received your requested item, close your thread by using the Thread Tools at the upper right corner of the thread and edit the TAG to SOLD. You do not need to PM a director to do this.

14. All thread titles must start with a "Wanted: ", "For Sale: ", "Trade: ", or "For Sale/Trade: " TAG and the title must be followed by a description of the item of interest. For example, "For Sale": 2x512 MB Corsair 3200 XL" or "Wanted" Any 802.11g wireless PCI card". As with every other forum section on the site, descriptive titles are mandatory ("For Sale: XYZ's clearance sale" is NOT descriptive - list at least a few of the better items). Free items should be listed in the Freebies Forum. Threads that do not follow this naming convention will be deleted.

14.2 Title Maintenance: You must TAG "SOLD" in the thread when at least one (1) or more item(s) are SOLD and you wish to halt additional sales or you've sold all items.
DO NOT request "Delete Thread" in the title unless NO items have been sold and for what ever reason you decided to remove the sale.
14.2. The appropriate [US], [CA], [EU], [Global] etc... TAG must be used.
Example: [US]/[CA] for sales offered to the United States and Canada. Or. the likes of [UK]/[EU] or just [UK] if the sale is limited to the United Kingdom.
14.3 TAG Maintenance: You must readjust the TAG accordingly to "SOLD", "Traded" or what TAG reflects the needs when all items are Sold, Traded or Found.

15. You may not ask for free items. No Wanted section begging will be allowed.

16. Wait a minimum of 24 hours between bumps. This counts for OPs and other members alike. Any post that's not an update by the OP or a specific question from a potential buyer/supplier is considered a bump. Excessive bumping will earn warnings or infractions.

17. If you observe posts that do not follow these rules, report the post by clicking on the "Report Bad Post" button under the "REP +" button. Appropriate action will be taken by one of the Forum Supervisors. You may also PM The Duke, Robilar RyGuy, or alexgheseger. DO NOT post negative comments. DO NOT quote rules in the threads as that only takes the threads further off topic. DO NOT state "REPORTED" or anything of that type complaint threads will be deleted and issued a warning or infraction.

18. Deals are made solely between members and are not the responsibility of Overclock.net even if they result in no payment, not receiving items, or any other negative outcome.

19. Any unsuccessful sales will result in full Overclock.net ban for the offending member if the victim requests it and provides proof of such. Sellers are fully responsible for their sales, including items they sell for friends, family, etc. If a member feels that they have been ripped off or has an Trader Rating issue, they should PM alexgheseger, TheLegend or Robilar with details.

20. Services, please refer to the TOS regarding this factor under the segment...

21. Wanted requests: You may NOT request a purchase be made for you in the WANTED section or anywhere in the forum. No offers like 'Buy this for me and...' are allowed in any way shape or form.

22. Report any possible issues with replies.
DO NOT engage in stating the rules, make NO comments to that fact!
