Tbqh for the OP, just run it in DirectDraw. Or try tweaking some stuff like perspective. Also, you can try the windowed method...you can try searching for it here (I posted the method) or ill just post it in a bit.
When i turn off perspective my fps goes from 20 to 100 (my refresh rate) so that fixed that but on my x1900 gt i have never had this problem and was able to enable perspective. I noticed that when i enable perspective next to any light source (such as a torch in Act 3) the frame rate dips. Nvidia doesn't seem to know anything about this and we should email them about these problems. ALSO, when i have vsync on i notice that the game does stutter but the frame rate is always above 60.

Diablo 2 has vsync?
Well, perspective is gay anyways, imo.
Well, I guess you could email them and point to this thread and other google threads.

Edit: if you play in single player mode, take off any mods or hacks, and then click on the Battle.net button. It should automatically update you to the latest patch if needed. If you're on an older patch, that may fix your problem.

I think once i see some reviews about the x2900 xt i might just buy that instead...
