thats very odd because even my 9800gtx+ can run it maxed with 34-59 FPS

Not in DX10 and all "Enthusiast". In XP of course...I get like 42-73 FPS usually. Vista is the real test here.

You can't use the rivatuner graphs to monitor vram usage in Vista? Really? I've never had vista, but it seems like I'd have heard at some point that this is a problem if it was.

Tell you what ... what happens if you lower the texture size down, like, to medium or low? Does it fix the problem you're having? If so, then you know what the problem is ...

vram is not the problem, i only have a 512mb pool on my 4870's and i get playable framerates on Enthusiast @ 1920x1200 (dx10), it only gets jittery in large firefights but not enough to merit turning the settings down. My only limitation is that i don't have the vRam for AA

That game is playable at around the mid 20 FPS already. The problem is that people start feeling like they're lagging if they see their FPS go around 24FPS (or below 50FPS for that matter), but if you didn't monitor your FPS and the gameplay was smooth, you wouldn't be able to tell for sure what FPS you're playing at.

crysis all on highest settings no AA (1280x720): 15FPS- 40FPS AVG 20FPS
crysis warhead enthusiast no AA (1280x720): 20FPS- sometimes 60FPS AVG 28FPS

is SLI working fine in warhead?what fps do you get with sli disabled?
does nvidia control panel have different settings for warhead from crysis?
