LOL i was just thinking that a factory OC card is at a way disadvantage since we are going by the % over the standard clock setting.

Not necessarily. The competitor can choose to submit either one; the stock OC from factory overclocking or the clocks that it would be if it wasn't overclocked. Info on that could be found pretty much anywhere that cards are compared (such as gpureview.com)
