Your situation was different though. If someone goes and downloads Limewire, and doesn't know the risks, or how it works, and has Limewire automatically search for media(instead of manually selecting folders), it's their own ignorance that's at fault here. Limewire isn't going to force you to share EVERY media file, it's only the directory you'd choose to share. If you own the music, and run Limewire, you should be expected to know how to actually use the software, and tell it not to share the music you own.

I don't see how you could really be angered by this, since it's your own use of the software that would cause these kinds of things to happen, and we can't get mad at RIAA for using the same software more intelligently.

I agree. It's not like they're looking at private files that you have. You choose to share them publically so anyone on the network can see what you're sharing wether they're RIAA or not. I believe that if someone's really worried they shouldn't be running it.

Hello...McFly...

Owning a CD does not give you the right to download copies of the songs on that CD. You can rip your own copies. The fact that you did not have ripping software does not change the law for you.

And you had no problem downloading an entire CD full of songs, but found it to be too much trouble to go download free ripping software? It wasn't exactly hard to find, even back in the stone age before Google.

This argument lacks any substance.

encrypting your connection doesn't do anything because they don't monitor your data. instead they are just seeing what you have open to the public. if emule works by sharing just like limewire does then you still have the same issue.

It is a good thing I hate most of the popular songs today, and buy all my stuff on iTunes or CDs.

you don't own the songs you own the right to listen to the songs. you do not have a right to distribute them.
that is what they are catching people on is distribution of music.

Exactly. For colleges, I'm sure its in one of their handbooks/agreements you get when you become a student at that particular college, that you will not use their network for any illegal activities.

I wish I remembered the source, but right now there is a lawsuit against the RIAA for just that fact. Their case is that this guy ripped his own music, and LimeWire happened to know about that folder so it was shared.

In my opinion, the illegal part shouldn't be offering them up, it should be downloading them. If I leave a diamond ring sitting in my yard 1 foot away from the sidewalk, that isn't illegal, but someone else taking it out of my yard IS illegal.

If there really is such a case, the RIAA is going to win. A person's ignorance of what their LimeWire software is sharing is not an excuse. You know for a fact that LimeWire shares files...you had better keep track of which folders LimeWire is sharing from and what files you put in there. Any other conclusion advocates the nanny-state mentality that the poor, poor idiots need to be saved from themselves, a mentality which has created such gems as the critically acclaimed "Coffee is Hot" warning stickers.

A false analogy. Your yard is not generally considered an open area where things are free to take; taking something from your yard is clearly not permissable. A true analogy would be if you had set up a table in your yard with a sign on it saying "You can take anything on this table for free"; and then you left your diamond ring on that table. Mistake or not, you told the world that anything on the table was free to take; so you have no one to blame but yourself when someone actually does take your ring.

I'll also point out that no one's opinion of what "should" be legal or not is irrelevant. It simply is illegal under current law. If you don't like the law, go into politics and try to get it changed, I guess.
