Apparently not in this situation.

They arrested this man who had only uploaded one album.

...uhhhh I don't think so. Because it's already apparent you don't know how the RIAA catches people.

whats really sad about the whole ordeal is that someone can drive around and find an unsecured wireless network (how many computer illiterate people know how to secure a wireless network?) and simply download it through their connection. Are they just prosecuting if you are in possession of the files when they seize the machine?

It also boils down to "Can I afford a lawyer that can prove that there is reasonable doubt"......either that or the court-appointed lawyer....

This is true. I don't see how it's fair to assign blame to someone's PC that belongs to a certain IP address......I wonder if there is a way to get the MAC address......this would be a little more precise, but it still doesn't prove that the individual actually accessed this info. I suppose someone could clone a MAC address and tie it off to another IP, then get sensitive info from a site......that would be a lot of trouble though.

I guarantee that they police confiscated every piece of hardware from his home when they arrested him. A person was arrested yesterday in the town where I work for accusations of child pr0n, and they got EVERYTHING: PC, keyboard, mouse, ipod, you name it.

Depending on the friskyness of the lawyer, he could go after the shop. If there is a way of obtaining the MAC address then they could trace that back to you somehow....they would have to be able to tie it off to your name (maybe registration, etc.?)

So the thing is - having a encrypted transparent partition, and when the cops come you shut down the PC and smile them wide.

Simple suggestion for British users of OiNK, just stay away from it for now and for people who are worried, there is always another option of buying the music, plus cd's are not that expensive anymore and I love them because I can convert them to Flac. Who seriously wants to listen to lossy compressed music?
