edit: This is interesting as the laws still seem somewhat vague. There still needs to be proof that the person arrested was the one that actually did the deed. Since that is almost impossible to prove.... Not a good sign either way.

It's a hell of a lot more possible on private tracker like oink, where it can be shown that a single IP has repeatedly used the same user/password.

True, but even then, there is no physical proof that it was any one person or another doing it. I suppose it all boils down to "reasonable doubt". Also, I am curious how this will pertain to minors etc. I am assuming the final step would be whoever is paying for the service and has their name on the ISP bill is responsible for the content moved via that IP.

For all I know, I can be at a internet cafe using their internet connection and downloading stuff. What happens then? The police arrests the owner of the cafe shop?
