I made personal copies of my music CD's and put them inside my house (near the front door), but leave the front door open (let's say I was just going to my car and back to get something from the boot or perhaps I just want some fresh air). And while I was not paying attention, someone took the copies from inside my house. Am I destributing them now? no. The same goes for my share folder; the fact that I actually place them there might just be to copy them somewhere for my own use. If someone else desides to take them from there that's not my problem (well it is in this example, but the blame would be on that person for stealing it, not on me for distributing).

You know, I thought that was an essential part of the justice system. Innocent until proven guilty. I suppose now we are following practices from fascist countries and the middle ages where the sentence is decided regardless of the evidence. Judges need to say "no" to the MPAA and RIAA... those two need to be told to just grow up. Piracy is a problem, but this is the wrong way to stop it.

I don't disagree with you on most of what you said, except that! Show that definition. Please somebody. I want to know a source.
Show me the official definition of piracy. "Unauthorized reproduction and distribution." I got that from Wikipedia. Putting it on a share folder isn't distribution... Even if it is intended. Thats just YOUR definition.

__________________but no, seriously... n response 2 rx7speed, those examples r exactly the same thing. if i have digital copy of a cd on my computer and have my computer open 4 sharing then its exactly like having a physical copy sitting on ur coffee table when u have a party at ur house. how should u b liable 4 having some1 steal ur *****? *****, i just thought of it..... if this somehow gets n2 the law books, then we as consumers can sue the artists cuz they let some1 steal their *****! awesome. this idea is absurd like the law that allows 4 plain criminals 2 break n2 ur house or whatever, but if they hurt themselves or if by chance u were waiting 4 them 2 come around a corner and u just happened 2 have a pick axe ready and stabbed them n the jugular, they can turn right around and sue u cuz u (or they) hurt them(selves).

What happened to innocent until proven guilty?
I know it sucks when it's so blatantly obvious, like some murder cases (O.J!!!), but it's needed to protect the people who are TRULY innocent. ~Gooda~

If they have no proof, then what are their accusations based on? No proof = no crime. Sounds like a bunch of paranoid Nazis run the MPAA. "We find you guilty, based on... on...umm, on... that empty folder on your desktop! Yeah! No doubt you deleted the evidence! See, your honor, the defendant is CLEARLY guilty!"

In criminal court, the standard of guilt is "beyond reasonable doubt" - in civil court (where the lawsuits are) it is much lower.
