I agree he should take it to court. The truth is, he won't. Ballmer and M$, in general, have used this "patent" claim for YEARS and have yet to ever take it to court. Why? Probably because they would lose.

Microsoft, are clearly software fascists. They try to spue propaganda on the open source community, they want to be the "one" the almighty hierarchy. They will lose in the end. They lose big customers every day. Capitalist cowards.

It will only show an outward lack of a point (and the placement of emotion over logic). I don't necessarily support what Steve Ballmer says. But if someone has specific complaint, it would best serve their interests to logically and reasonably state why - and if the business displeases them enough, not buy it's products. People making that decision is the ultimate determinant of whether or not that business entity will continue to exist.

He's made the claim for a year that OSS has violated these 235 patents but has not revealed a single specific patent they are talking about. Makes you wonder why he hasn't listed them.

its rubbish. microsoft doesnt hesitate to sue anybody if they can win. the fact they havent puts the truth out there for everybody to see. just because ms has been granted patents, doesnt neccesarily mean that they were right to have been granted patents. Open source projects dont require patents, and therefore many times pass under the radar. Lets say I go code up a sexy little program and open source it.. its a huge hit, microsoft feels its a threat, codes up something similar (or encrypts my code and claims it to be theirs) and patents it.. well... technically its theirs now, because I didnt properly patent my open source software. its a loophole in the system that MS is exploiting. they are no better than con-men. to say that its business practice is an understatement. business practice is to undermine and demean the competetion, not attempt to convince the general public that using competition is illegal! He should be sued for defamation of OSS character and noise pollution (because he is polluting our atmosphere with bullcrap)
