I don't personally see anything wrong w/ friends 'sharing' stuff, but technically it is still illegal, and doesn't have anything at all to do w/ the fair use act.

That would mean anyone going to a nightclub or any other kind of venue that has a dj would be illegal. Radio would be illegal, hell I used to tape things off the radio when I was young (back when people still used walkmans lol) and yet no1 got in a big fuss about people recording the radio. So whats the difference now? is it because its just easier to find?

Honestly doesn't make any sense to me, specially if the defendant WASN'T selling the songs. If anything artists/record labels should pay the "pirates" for FREE ADVERTIsING!!!!

It was made a big deal back then. The cassette tape was going to be the downfall of the music industry. They ran campaigns and lobbied on the evils of the blank cassette tape.

No it doesn't. Dj's (maybe desperate ones) playing at nightclubs or other venue's don't work for free. They are paid by the owner of the establishment to be there. When you go to a concert, you pay $$ to be there. Do you think a radio station doesn't have to pay any form of compensation to the artists (or their representatives) of whom's music they play? Running a station isn't free, they have to air commercials for a reason.

I used to tape things off the radio too, and back then the industry was 'z0mg tapes oh noes!'. Did I or anyone else give a crap that I recorded of the radio? No. Was it technically a copyright violation? Yes.

Nothing is different here. The main issue at hand is how rediculous the fine is and what's going to happen now. Every knows the fine is excessive. She may as well have walked into hastings, filled a shopping cart w/ cd's and shot 3 employees on the way out the door.
