It's just a matter of time. There is no such thing as unbreakable software. By it's very nature alone software is unsecured. It'll just take time for them to find the weakness.

It's going to take much more time than usual. Right now the Dev Team is stating if you have a OTB 3.1 iPhone 3GS, then you are out of luck, and possibly forever since there are far more restrictions set in place from Apple.

What if it was 3gs 3.0 out of the box and it's been upgraded to 3.1? Mine's never been jailbroken before; can I go and do it now?

No. Unless your phone was jailbroken before and had your SHSH on file with Cydia, you can't jailbreak. If you had jailbroken and updated, you'd be able to downgrade and then load the 3.1 jailbreak, but since you weren't jailbroken and are now on stock 3.1, you cant.

Basically, if you are on STOCK 3.1, you will not be able to jailbreak the 3GS anytime soon.

It gives permission to access the iphones files so user can put homebrew, themes, apps, etc.

I'm sure they are not the only one's working on it. Like I stated previously, there no such thing as unbreakable software, it just might take a different approach. If the Hackintosh crew is anything to go by Apple isn't the best at security either.
