if you checked the licensing link it states that if they wish to sell the games then they must pay for a license. the terms of that license are 25% of the profits after $5,00 in addition to a $99 upfront fee.

Which is totally not a big deal. $100 is nothing, if your game flops, who cares. If you start raking in $$$, after 5grand epic starts to want a cut (rightfully so).

hmm UE3 is cross platform isn't it?

Wonder if this will include tools for developing on the 360.

in the licesnsing it says that console development tools and code are not part of the free to use license. you have to purchase a license from them still in order to develope console based games. although if you are smart enough you may be able to figure it our on your own.
