Great, this is a common sense move.
No matter where you stand on internet piracy you can't make the ISP's responsible for doing police work. Do you want your ISP to deep level inspect all your packets, decide which sites you can and cannot visit and report any suspect activity to the government? I wish someone would put these big content guys out of their misery once and for all. Oh wait, the internet is going to that. Artists are more and more able to directly reach their audience. I predict that in 50 years you won't have huge publishers/promoters like EMI, Sony, etc. There will be big open networks where people will sample new artists works and then buy what they like.

I am sure there will be an appeals process. Crippling legal costs may be a deterrent to others. Just because they won in that particular court does not mean it did not cost them money defending themselves and that they wont have to keep spending money on attorney fees.
