The parts dkim1359 posted aren`t bad. I would throw the dvd burner out. I assume you have one and these things don`t need to be upgraded, imho.
I woudn`t pick a mobo from asrock.
Get something like this:

A better CPU cooler than the hyper 212 would be nice but more expensiv.
The RAM looks fine. These G.Skill are unexpensive and great value.
For the PSU i would recommend Thermaltake, OCZ or Corsair. 550W will do but better 600w.
The only thing that is sad that you will have to cut some money for the OS.
A 6950 would be a good choice.
So the main parts would be: the 2500k, a 6950, the RAM from G.Skill, a Gigabyte P67A-D3-B3 and an os. The rest of the money should be enough for the other parts. The most important parts left would be the cooler and the PSU. I would cut on shiny case and invest that money into a good cooler/PSU! You can`t live without them but without a shiny 300$ case!

Sorry, no link. It was in a printed ad that I had, but the sale price must have expired. You can get either of these though:

I don't claim to know how good either of these boards are, but I have seen several posts with people using them on here. For budget reasons only, I'd go with the Biostar. If you want something better, then its up to you and what you can fit into your budget.

If you RMA it then you should be fine because you have the same mobo. If you sell your current one and then buy a new one then you technically need a new one next time you wipe your OS. In reality you could through 20 rigs with the same hard drive.

The gigabyte i posted is 115$. It has USB3 and but sadly only one 16x PCI-E slot.
But this would be imo nicer than something from biostar.
And most guys i`ve seen here use asus or gigabyte...

thanks for the input guys, definitely helps and is pushing me in the right direction.

I WILL be planning on OCing, but i'm by far not an expert at it so would prefer a mobo that is easily tweeked.

this rig is pretty much 100% gaming/daily web browsing.

I was gonna throw together a build based on Microcenter, as everybody goes the newegg route, but at Microcenter you can grab an i5 2500k and Asus P8P67 for 329 and that's a really solid base for any build and work from there. It all depends on how close you are.
