He's not suing because it's down he's suing because their network was breeched and credit card information may have been stolen.
There are a few simple things you need to do in situations like these.
Step 1: cancel the card the people had information on
Step 2: don't use the same email and password combination for multiple sites; I'm sure everyone here has AT LEAST 2 email addresses and probably at least two debit/ credit cards. If a log in somewhere uses an email address, don't use the password you use for the actual email account; use different accounts for different bank and credit card sites so if one is compromised they can log in to all of them
