I don't understand how you can sue a company for getting robbed.

I am sure its not like they left the door open and invited the robbers inside. This sort of thing doesn't happen everyday and its look more and more everyday like this was a professional job from my understanding.

the sharks are in the water. I think it has more to do with the fact that Sony has to adhire to a number of standards when dealing with credit card data.

Plus I've been wondering...

When I asked my credit card company for a new account number they asked my why and told them because I may have been affected by the recent network intrusion on SOE's customer database. My old card number has been deactivated and a new one is on the way. This has to take at least some employees' time at the credit card company. Do you think they send Sony a bill for it? I mean there has likely (hopefully) been millions of similar requests all because of the same reason.

This could end up being an expesive ordeal for them. I would imagine it already has been.

This plaintiff might have actually picked a reputable firm in Canada rather than a shoebox lawyer...

It's actually illegal for lawyers in Canada to take lawsuits on consignment (with the exception of slip and falls).

If sony wants to play the crying game, this could cost the plaintiff potentially tens of thousands of dollars in legal fees.

Disbursements alone would be a small fortune. Sony simply cannot risk settling this one (creates a precedent). As such they will bury the plaintiff.

However if it becomes a serious class action suit with multiple plaintiffs and is actually undertaken by a decent sized lawfirm (like Weir Foulds or Goodman and Carr) then the firm would utilize its own warchest for suit funding and then Sony would be more likely to settle.

I'd understand suing Sony if it was their fault...but getting hacked is not their fault. If a hacker gains physical entrance to your computer and steals your personal information, it's not your fault is it?

Nope, but if you were storing a bunch of other people's personal information (with the assumption that it would be safe) they would be justified in placing some of the blame on you. This is especially true if you have shown a lack of due diligence in securing their data.

You two have got this wrong. They're not suing sony because they got hacked their suing sony because they screwed up.

Think of it like this, You have a House sitter watching your house while you're on vacation. During the time you're away, someone broke in and stole your grandmothers WWII ring that was passed down from generation to generation. The baby sitter knew about it and decided to wait a few days after you returned to decided to inform you that it was stolen. IF they would've been informed sooner that the ring was missing, you could have taken the appropriate actions sooner in hopes to get it back.

Get it? Hopefully no one else thinks they're suing sony on the sole fact that they were hacked.
