[edit] there is a HUGE difference between cause and suspicion, HUGE difference. If you get pulled over and the officer suspects you have pot (smoke) in your car they can legally detain you off the suspicion of owning a controlled substance. That is why if you deny the search of the car they can DETAIN YOU, get a warrant, then search your car anyways. Seriously, this is the problem with the united states. People don't pay attention to the laws or what rights they have or don't have then post BS because they believe it's right.

Maybe I spent over a year in jail, 10 charges, and a lot of lawyer work to understand how this works. Point out what I said that was wrong or inaccurate and I'll give you a cookie.

[edit] Read the (smoke), that is reasonable suspicion. He cannot prove that he smelled pot, it's his word, there is no real proof. More epic fail.

Do I have to clarify again that reasonable suspicion does not mean reasonable proof? I could have smoked all the pot and only have smoke left. I could then pass the DUI test, yes they give you that, and have my car clean only to be detained against my will until they feel that I am clean.

No, it is reasonable suspicion, cause you can't prove that they smelled the pot. Reasonable suspicion is on the discretion of the officer, it goes to court and ends up being his word against yours. That doesn't mean he can detain you, however if he believes you need to be detained so that he can preform his duties he will. Soul discretion of the officer in charge.

So essentially they can detain you at will without any proof that you have done anything wrong. You could be in the wrong place at the wrong time, it happens. Depends on your view of suspicious, I'm not going to legally define suspicious because I don't care as that could change from officer to officer. One officer might think the other is just using reasonable suspicion for the soul purpose of pulling people over, while the other might think it's valid. This is what a court is for and not a message board.

[edit] Suspicion can also be situational, too many variables and too many situations to argue this. We would literally fill pages before we found a legal "definition" of suspicion. IMO it's a bull**** ability, however I understand where it's a necessity.
