Just because a cop thinks you have marijuana on you does not give them the right to frisk you. He needs reason to believe so. oh yeah smelling it on you... which leads to cause. He then has probable cause to search you.

If you are looking at cars with a coat hanger in your hand without doing anything, that is reasonable suspicion. If he sees you with your coat hanger IN a car window that is reasonable cause.

If you didn't spout off like you thought you knew what was law or not, i wouldn't have to come in here and correct you.

Read about a guy in Lancaster who worked loss prevention for a local supermarket and got shot trying to stop two shoplifters in the parking lot. Stopping shoplifters is like police making a vehicle stop - dangerous and unpredictable. Anyone who believes otherwise is a dimwitted fool. Have to say I agree with Best Buy on this one. Employee violated their policy on shoplifters (which he had been informed of) and got fired as a result.

Frisking the person is a different story, any personal property has to go through a different warrant. They can detain you and search your car, I never said they can detain and search you. It's a lot harder for an officer to search what is on you and in any locked devices you have. That's a different story if you want to get into that, which I didn't say they could or couldn't do because I left that out. Now you are just assuming.

1- it is alot easier for an officer to search you. It goes right to "officer safety"

2- An officer needs probable cause to search your car if you do not say ok.

It's like this where I work as well (Family Dollar). I have been told the story of a woman who worked there, though.

Someone stole money straight from her drawer and ran. She decided to chase them in return...about a half a mile down the road. The sad part is that she caught him and got the money back. The district manager was so mindblown from the story and the small part of it caught on tape, that she just told her not to do it again because of policy.

1) Actually in all cop cars you are on camera, if you peaceably deny the search all they can do is detain you. I've done it, my friends have done it. That's why it's in your best interest to be on the camera at all times, refuse to go out of it's sight.

2) Yes and no, they can detain you and get a warrant. It depends on the judge at the time as well as the time of the day. You are more likely to be able to say no at night than you are in the day, due to the fact that no judge is going to wake up to sign a warrant for a car at 3am. More or less today they can use reasonable suspicion. It's becoming more and more of a standard for searches and warrants, read up buddy.

[edit] As I said, we can argue situations all we want. When it comes down to it they do not need reasonable cause, it is just preferred.

A lot of hate on best buy here. I am not a fan of best buy but this seems more like fan boy rage than anything else. Laws in most states don't allow stores to do anything other than to call the cops on a thief. In NJ I know you are only allowed to stop someone if you witnessed them actually steal it(this doesn't mean tackle them to the ground). If you didn't see it you can't do **** about it. That guy will sue the **** out of Best Buy now and be able to afford 200 of those laptops easy. They aren't the police.

Also those of you arguing about laws, you might want to state where you live because laws vary state to state and country to country. It is apples to oranges if you aren't arguing laws form the same area.

This^ It's very bad customer service. Usually, the only people allowed to do this are certified LP employees, (lost prevention.) These guys are the ones that are in control of company inventory loss, and are allowed to pursue customers but are not recognized in the open as regular employees who interact with customers on the sales floor. They are a special unit that deals with these types of people/situations.
