All that proves is that one server may have had up to date Apache. Sony's network and internal/external world wide web structure is massive. It could very well be the case that some networks were using older Apache versions.

Did the hackers cause this? Yes.

Is SONY blameless just because it is the victim? No.

Is this in any way like rape? No. Though the hackers apparently did give SONY a good kick to the crotch.
