XFX 5850 and MSI Afterburner

So I just got my beautiful, new XFX 5850 from TigerDirect this morning and I have some really stupid questions. I have never overclocked a GPU and would like to keep this thing in RMA-able form. I make ZERO money on a regular basis as I am the epitamy of the poor college student. Now I was wondering if XFX has any way of knowing if I used MSI Afterburner to OC this card up to 775 or 825 core clock and down clock the memory to like 700 or 600 memory clock? Will it save these settings to the card's BIOS or is this all just saved to the software and no evidence of an OC like that is stored on the card? Anyone have some info on this or am I just gonna have to wing it at stock?

I got both of my 5850s to 900/1200 on stock volts with the fan speed sitting around 50%. And as long as you dont tell XFX that you did overclock then they will still take it back for an RMA. If you flash it to a modded bios just make sure you back up the original so that you can flash it back in case you have to RMA it and the just play dumb when talking to a support rep.

Is 88c at stock settings and 44% fan speed ok for the XFX 5850 non-reference card at full load or is that a bit dangerous?
