Its an upgrade, but I've heard of people being able to use it as a regular install.

If I'm wrong someone correct me.
You totally can use the Win7 Upgrade from the MS student site as a regular install - one of two ways.
1) For some people, you just install, and you can activate it, and doesn't even ask you for a previous install. This is what happened to me.
2) If it does ask, you can install the upgrade again. Believe it or not, the previous, inactivated version of Win7 Upgrade counts as a previous install, so the upgrade install after that works. This, by the way, is perfectly legit via MS.

My Uncle has a Dell OS 'restore' disk, which has Win7 Ultimate on it. It doesn't ask for a CD key when installing, and is perfectly validated. We've used it on 6 computers so far as a fresh install rofl. Manufacturing fail?

You are correct. There is a work around that will allow you to install an upgrade as a full install.

BUT STAY AWAY FROM THE SITE. DON'T BUY PRODUCT KEYS LIKE THAT. HALF THE TIME THEY ARE BLACK LISTED.

Most probably they could be selling MSDN keys using an MSDN account. The reason I suspect this is because the only cheap Windows 7 is sold by Digital River an MS partner.
I believe you are dead on here. I read somewhere else that a site was doing the same thing and one day all the keys were blacklisted by MS which left a lot of people without an OS.

Nope, the upgrade was an absolute pain in the ass, and I didn't even end up using it. Honestly, just grab a modded version of 7 online somewhere.
