No, you are not in a similar situation. A videocard is a dam sight more robust (especially a shrouded one such as the GTX260, which i assume is the card in question) than a motherboard covered in exposed caps, pins and sockets and heatsinks. Stop being so dam ignorant and try the card.

Sounds to me that he bought the card and decided he didn't want it and is trying to get a reason to return it, especially if he is refusing to even see if it works based on principle.

Because if he wanted the card he would at least test it before saying he was thinking about returning it.

I would try it first regardless of packaging, especially if there is no visible damage. I agree with you on the fact that it should have, at the very least, had an anti static bag and you should either warn the seller or pm me his name so I know to shy away from him. Personally I ship my items to the very best of my ability, I ship them how I want stuff shipped to me.

My point is that it isn't the right way to sell stuff. Honestly, I bet almost everyone would expect a card to be packaged with an antistatic bag when you buy a card. From the packaging, it can be inferred that the seller doesn't really care about his hardware and shoves it in a box.
