Bandwidth isn't cheap
Then you shouldn't be selling 10,000 keys if your pool only holds 100 people...

In relating to Netflix though the bandwith doesn't have to be cleaned as the pool would so that's not quite an exact analogy as cleaning the pool is an added cost that Netflix doesn't have. I agree that bandwith isn't cheap. But I still say if you promise me UNLIMITED access you need to budget for me using my bandwith 24/7 and make sure you have the capabilities to provide that to all your customers.

This... is retarded. So let me get this straight. They're saying that if I go to a friend's house, even if he says I can use his account when he's not there, I'm breaking the law if I do and I could go to jail?

If so, I laugh at the absurdity.

The problem is that we already made an agreement you wouldn't do that so you in essence are breaking our agreement. It's like every time one of the other people come to the pool they say it's you so I let them in. You've defrauded me and so have they.
AHHH the agreement... Yeah if I signed an agreement when you gave me the key that said I won't share it then I agree with you that I'm defrauding you based on our agreement, bud I'd still disagree that you're truly losing revenue because of it.

Does Netflix have a line in their user agreement that says nobody else can use your login information to access your account though?

I'm not digging but that's one of the first things I would add if I were them and you may not be losing money to every person I loan my key too but some would pay otherwise.

I wonder if most of you even read the article lol it dont sound that bad really looks like the law is being made to stop hackers that are selling stolen login and passwords so it has a big upside. And this would need to be reported by say netflix or other services im sure most probly would just terminate the acount or warn befor they got the law in it.

While those who share their subscriptions with a spouse or other family members under the same roof almost certainly have nothing to fear, blatant offenders — say, college students who give their logins to everyone on their dormitory floor — could get in trouble.

Was lending a Blockbuster rental (R.I.P) to your friend illegal as well?

What percent of the fine does the government keep and what percent of the fine does Netflix keep?

These people enter into an active agreement with netflix (if you want to distinguish it from licensing agreements with media which people do not enter into in the same way). They then breach that agreement which in turn costs netflix money (if not through media, through bandwidth, although they may have to pay money for everything they show or companies may ask for more if something is more popular).

It's like if I had a pool and I charged people to use it and gave them a key to come swimming whenever they want and then they gave their key to their friends and they all went swimming at the same time. Sure I still have a pool but I missed out on selling other people a key to it and also probably have to clean it more and have additional costs due to more people using my pool.

So if I leave and allow someone else to use my key while I'm gone there's still only the one person in the pool. Thus "technically" you aren't losing anything. In my opinion anway

Bandwidth isn't cheap
Isn't this where you say EULA != Law?

It isn't the state's responsibility to find out who is abusing netflix or rhapsody accounts, it should be the service provider's responsibility.

Nobody is awake 24/7, and unless you're an unproductive member of society, you won't watch more than one movie per night, with exceptions on the weekends. Thats the budget they work with.

If businesses were required to work that way, insurance prices would be hell.

I kinda breezed through their TOS and found a couple lines that pertain to this...

"If you disclose your password to anyone or share your account and/or devices with other people, you take full responsibility for their actions"

"You also agree not to impersonate any other person while using the Netflix service..."

I suppose the impersonate part kinda adds that exclusivity to the agreement but iiiii dunnnnoooooo...?
