If this isn't on the Warcraft 3 engine inside of Warcraft, they're going to have some serious issues building the game without getting sued by Blizzard. There's so much they'll have to change.

Lolwut.

Sue them for what. Blizzard only gave users the tools to create content, they didn't make it themselves. Even though they own the user-created content, there is nothing to sue for. If this was the case, Blizzard would be suing every indy company who makes Tower Defense games, and every 'DOTA' clone on the market.

Half the item names are ripped out of of D2, lol

and the character models are blizzard's property.

Luckily the hero names and most spells were original so they'll just have to get a good graphic artist to re-create similar looking character models.

I'm pretty sure that anything you do with Blizzard's editors are tied to them somehow legally, might want to check out agreement, but it would be pretty stupid to be otherwise.

Then there's assets and all.

Tho Valve might have come to some sort of an agreement with Blizzard, cause Blizzard is not really going to make a similar game. Valve would go ahead with the development unless it is a sure thing.

That's where I disagree with you.

Speaking specifically about the original DotA found on Warcraft 3:

The majority of the hero models are all taken directly from the editor, using Blizzard's own content. The majority of the art and effects models are taken directly from the editor. The entirety of the sound effects and character dialogue are taken directly from the editor. The majority of the 2D icon models (for items & skills) are taken directly from the editor.

Blizzard owns the rights to their artwork, which I have mentioned above. The majority if everything found in DotA is simply ripped straight out of the editor, and tweaked a little bit. DotA 2, if it wants to be separate from Warcraft 3 and Blizzard, will have to make some very distinct changes.

I don't get why people say DotA is its own creation and Blizzard just gave them the tools to create it. On the contrary, DotA borrows from Warcraft 3 so heavily that I don't think a lot of DotA fans want to give Blizzard credit where credit is due; it seems many followers want to give the DotA game more credit for originality than really is there at all.

Heroes of Newerth is definitely different enough. I didn't like that game enough to purchase it, but while trying the free demo, I found that it was similar... but not "we-stole-Blizzard's-look-and-feel-and-original-artwork" kind of similar. I guess we'll have to see what DotA 2 looks like, and what content they decide to carry forward from the original DotA.

You are right that a lot of the artwork is taken directly from the game, but there are a ton of custom models, icons, skills etc. Its not like they are taking the models and whatnot directly from War3's editor and putting them in DotA 2. They are building the game from the ground up and if Valve creates models that look similar but not identical to those of War3, I don't see what Blizzard can do about it.

That said, I could be completely wrong. I haven't read the editor's agreement nor have I looked into the matter otherwise.
