I think you misread or I didn't make my point very clear.

The punishments should be levied to those filing patents that clearly have no standing and are just being filed for trolling.

For example, patenting things that have been in wide usage for years or patenting extremely vague process/technology which is inevitably going to be used and even petty design patents on obvious things.

This would most likely greatly reduce the number of patents being filed in the US but still allow valid patent holders, be it in small businesses or large corporations, a legal standing to properly defend their own patent.

Didn't Windows Messenger come ready installed on Windows XP in 2003? 2 years after Kootol claim they invented it, and lets not forget about emails the first email was sent in 1977 (I got that information from Wikipedia) that is a 1 and 2+ way messaging system
