Great point. The publicity on this incident is growing and with the hits comming into this thread, I can see it staying on top of google for a while. It would really be in XFX's best interest to make things right for the OP so that the future prospective customers who look into the matter through google find this thread and a happy resolution ... such as the OP getting an upgraded card for his troubles.

I actually do have a direct hand in the RMA process. The XFX Technical team for all of North and South America is less than 10 people. So less than 10 people that do tech support, RMA, and testing.

As a result situations like this definitely hit home and can be a bit more personal.

I hate to brag, but my evga gtx 295 recently started to artifact... I called evga, created a ticket, submitted request and sent the card out...
Note I opened this card and over clocked/water-cooled that baby...
I did a half ass job putting it back together and evga actually emailed me saying that I forgot to put back some backplate on the card and charged me $10 for it...
What do they do after charging me?
They send me a gtx 480 for my older setup... All within 2 and a half weeks... Couldn't be anymore happier...

I would recommend evga (even if they are just Nvidia) to anyone... And sorry for the horrible customer services...

Boxes don't always give a picture of the condition on the contents. They did tell him, and it really sounds like the OP had no idea what he's doing. He should have been asking, demanding answers at that time. Scratches head... I wouldn't have let them ship the card back until I talked to a manager.

I can say, the one time I did own an XFX 5770, I submitted an RMA for a loose fan cooler assembly. They gave me the option to send it in or get a replacement cooler sent to me. I opted for the cooler to be sent and I installed it with no issues and closed the ticket. For me, it was a simple RMA, but I'm always surprised when I read about these XFX warranty horror stories.

Class action will NOT be a legit claim here and would cause XFX to actually fight it.. A small claims issue will be fine seeing as it's just a bluff basically. Even if you win in small claims good luck trying to collect but the point would be that you have leverage when you scream lawsuit and mail them papers

those of you who followed my thread and always wonder how it concluded i will pass along what i have as of now.

I'm currently on day 503 and i have made preperations for legal filings and small claims. I'm
going the easiest route first and pursuiting further action on an escalated and needed basis.

I want to mention during the entire process that i have moved and that did delay the situation
somewhat, but the length of time to have nothing in return is far beyond ludicrous at this point.

I was told by a represenative named erik that i unfairly tarnished xfx's reptuation. I, however,
do not believe i have done so and only one to blame for such tarnishment is xfx themself. The
situation did go as far as being escalated to the vp @xfx whom as of this moment has denied
replacing the card. That was 2 weeks ago.

I never went on the trip because i found it odd that a company would rather spend time, effort,
and not to mention money for a cause of side stepping the issue. I felt that my presence at their
facility opened me up to scrutiny by employees, and it didn't even solve the problem. I just
wanted a card so that i could get back to playing games. I'm currently on a borrowed laptop and a
borrowed video card (thanks xtremecustomz).

The new thread of worthless and borderlining criminal service by xfx prompted me to make an effort
to update the other closed thread.

You can't prove he took them when he received the product either. Works both ways. Now if OP can show he has taken pictures of other returns/RMAs, then he has a very valid argument.

Well, they do when they've read any number of RMA denial threads.

But yeah, even if the EXIF on the pics has dates that line up with his UPS ship date, the way those pics were taken don't make them irrefutable proof. Taking the pics at the UPS store with a few wide shots showing the store interior would have done it though, XFX would have no way out. It would be their problem or their claim with UPS.

In general you shouldn't have to fight so hard with a company when reasonable efforts were made to prove your card shipped undamaged, its poor customer service and bad for their PR.
