Sapphire 5870 Issues

So I got this Sapphire 5870 1 GB version back in December and have had random grey vertical screen lock ups or just totally lock up on the screen I'm on with it since I've had it. Sometimes Windows will catch it and say the Display driver has stopped responding and has recovered. It only happens on my desktop and never while gaming. It happens anywhere from 1-2 times a day to once every 3-4 days.

It idles at 157 mhz core and 500 memory with 1.050 volts. This card has a locked voltage so I can't even try to overclock it like I've read some people do to fix it.

I sent in a support ticket to Sapphire about it and they sent me an updated BIOS for it. This was about 3 months ago and it seemed to help for about a week and then it started happening all over again. My current bios is 36486.

This was happening with my previous build computer(e8400), and now my new build is having the same exact issue.

Not sure if it helps, but the SKU is 11161-01-40R

The card seems defective to me. If it is still under warranty I would RMA it.
