I sent back a 9800gtx+ to gigabyte about a year or two ago. Now, I don't know if their service has changed, but my rma was painless and I got a working card back in about 2-3 weeks.

Recently the RMA departments of certain companies
*cough*XFX*cough*Gigabyte*cough* have been denying peoples' RMA's due to "physical damage" on products that most of them probably didn't even cause. Although hard to believe, some speculate that the RMA people may actually be the ones creating the small nicks and scratches (don't quote me, just speculation).

I personally had an issue with gigabyte's RMA dept. I had G31M-ES2L mobo that had no video output... checked the board, didn't have any damage. When gigabyte received it, they took pictures of a completely severed lead at the back of the motherboard, one that I never, ever saw or made. Fortunately, they were "nice" enough to resolder it, and sent it back at no charge.

I've actually been impressed by Gigabyte's overall customer support, but this is mostly because I see people use the Gigabyte forums before contacting the RMA services. DarkMantis is a pretty big help in assisting people with issues, and I think he also has some direct contacts with Gigabyte to ease the RMA process.

I don't even know why you would bother RMA'ing a card if it's running hot. Replacing the thermal paste alone usually nets a significant drop in temps, and improving airflow in the case will help. Running hot is subjective, and in this case who knows whether or not they RMA the card. If it tests fine, they might charge you again to send it back. Worst case scenario if thermal paste change and airflow doesn't help, 3rd party coolers can be had. I hope they RMA it fine for you, I would think they should. But for me, I would only RMA a card if it was actually defective, like artifacting or dead.

Get a pic of the top and bottom of the card in case they say it has any damage,also make sure to get the serial number so you know whether you get the same card back or not.
