Backstory: Aaron Schwartz is a political activist who, among other things, opposes all the recent internet censoring/controlling legislation proposed recently. He's also pro-Wikileaks. Apparently for one of his projects he needed access to a lot of academic papers, so rather than download them all manually he wrote a Python script to download them all quickly. However, this stressed the uni's server and violated their terms of service, so they sent him a nasty notice and someone complained to the authorities. Schwartz was then arrested. The university then stated they did not want to press charges, but police are holding Schwartz regardless on the grounds that he was "hacking".

Apparently someone's pissed about him being held.

I haven't read anything about this elsewhere, so I may be off, but it sounds like this guy didn't break into anything. If all he did was write a script, he likely did nothing more sinister than what the old download managers used to do in the dial-up days. He might have hammered the servers a little, but that hardly constitutes hacking.

It appears he didn't actually "hack" anything. He just used a script to download faster than manually clicking buttons with the mouse.
