crysis 1 or 2? What are you using to check fps?

You are probably getting a lot more fluctuation on the higher settings. Dipping way lower on your minimums than on High. It is the low min's plus constant fluctuation that usually makes a game feel sluggish. You may not even be seeing the low dips because it happens so fast that whatever you are using to monitor the FPS isn't picking it up.

frame rates are not dropping im using the r_displayinfo 1 in crysis 1 im getting a steady 40FPS on Very High but it feels slow

I'd blame a low minimum FPS, personally. My SLIed 260s got pretty much the same fps in BC2 as my 470, but the 260s felt slower.

EDIT: to explain further. Your gameplay experience is pretty much determined by your minimum framerate. A 50fps average does no good to a man who has lows of 10 or 12.

Use the crysis benchmark tool, see what it reports for minimums. I bet it is much lower than what you can see on the screen, it happens way too fast to notice with the naked eye. I blame low mins.
