Does Palit have a phone number to call? I always call for an RMA. Email is easy to blow off, they can't blow you off if you call them.

I see them either giving you a GTX 470 or a Refurb GTX 570....maybe a new GTX 570. Most likely because of the memory size.

Yeah it contributes... by making the difference less than it otherwise would be with identical platforms. There's no way an i5 2500k at 4.7Ghz is going to be a slower platform than an i7 920 at 3Ghz for the purposes of 3DMark11 benching.

470 > 560Ti when both are overclocked aggressively. A 470 at 850Mhz is running at a 40% overclock on 448 cores. They don't perform that well in benchmarks because nVidia purposefully clocked them low to create a justification for the initial $150 price difference between it and the 480 (which were released simultaneously). No other Fermi has overclocking overhead like the 470, which skews the perception of their performance capabilities when comparing stock vs. stock benchmarks.
