Actually Oracle's case is even more shaky than Apple's. The lines of code were part of a test suite for the Sun JVM, they were freely available as open source on Oracle's/Sun's website. Google didn't even get them from there. They got them from Apache's Harmony project.


Oracle wasn't suing for anti-competitive motives though. They were suing because they have a terminal case of massive stupidity. They can't accept that when they acquired Sun's java technologies they didn't acquire the language itself, so they are trying to sue everyone that uses their own implementation of Java.

But hey, I do agree about the entire "patent system failing" thing. The patent system was originally made to protect small inventors. Now it's just a way for some to get easy money. Still, we shouldn't call a company a patent troll just because it sues some companies over a patent it owns and uses.
That's what makes Apple different from a patent troll: patent trolls patent everything they can, put everything in a closet and wait for someone to involuntarily use something they patented.

Exactly. Apple is seeing its competition close the gap in sales and market shares every month. In an effort to slow or stop this they are using the companies that are most likely to hurt them, HTC and Samsung. More than likely if LG and Moto were selling at or near the amount of Android devices that those two are we would see suites against them also.

The real target by all these suites is Google but I dont think Apple wants to relive this, Apple v. Microsoft. They have tried this whole "look and feel" BS before.

This caught my eye. It may be for desktop OS's but this IMO sets a precedent.

There are 4 categories of people when it comes to topics of Apple:

1) Those who don't care,
2) People who will protect Apple, because it's Apple,
3) People who despise Apple, because it's Apple,
4) Semi-objective parties who take sides.

Now, let's break this down. There are plenty of people in this thread just shouting how much they hate Apple. Repeating what other people say, and using it as a basis for their argument. There are also those (perhaps not in THIS thread) who will shout for Apple because they are constantly scrutinized on OCN.

What I want to address are those who refuse to see valid points against Apple - even if they are not fanboys by any standard. There are normal patent trolls. Most large corporations can be considered such, especially in the tech world. Yes, large companies sue each other over patents on a daily basis.

The main difference being that for the most part, it is for legitimate reasons, and legitimate patents. Apple has an incredibly amount of arbitrary patents strictly so they can perhaps nail their own competitors in the future. They do not like to lose market share - Steve Jobs is more or less a crybaby - and the way they retaliate is attempting to rid the competition.

Now I know companies like Google, and Microsoft have incredibly vague patents as well. However, they do this for the sake of intellectual property, and to prevent blatant stealing of such technologies. Rarely do you see them directly attack a competitor, unless hardware tech, or lines of code were legitimate stolen from one another. This is how the tech world should work. Competition is your friend. Apple has forgotten this.

Apple has now tried to ban Samsung from the U.S., and is currently trying to ban HTC, because of things that are necessities within touchscreen phones. Yet, they haven't attacked the company that creates Android. Reason being is they believed they were bad enough to take down Samsung, forgetting how large the corporation itself is. And they'll head towards HTC, because they're smaller, and maybe they can win. Google would stomp them.

Patents are great ideas *IF* you use the idea and enforce the propriety of it's usage.
If you don't enforce the propriety of an idea,then you stand the possibility of losing the patent right.
Since touch screen phones with icons have been around for a quite while,I can't see how a judge could back up Apphole's patent claims.
They just haven't bothered protecting their rights in the past,so how can they legally do it now?

If I invented an awesome phone and a month later everyone steals my ideas and makes a blantant copy I would be pretty pissed.

I know everyone's gonna say "Android is completely different from iOS" Well you have to consider what the average phone was like prior to the initial iPhone release.
