Intel stock cooler is pretty terrible.
I dont think ambient may play a role, because over here at my place its hotter! and alot of i7's /i5's run with the stock cooler. just saying.

the ambient is about 77-79f. i just installed a newer version of core temp. now my tjmax is 98c and it says im runing about 38-40c

as for the tim not spreading.. when i first installed the heatsink. only like a tiny bit touched it so i know that it wasnt seating right. i had a feeling thats what it was too but i wanted to check a couple things first. i personally dont like seeing these kind of temps at idle. thats about wher my load temps were on my e8500 god i cant wait to get my new waterblock this blows.

so is it common for the uefi to put a big load on the cpu and cause it to heat up. and are the temps more accurate in the uefi then say speedfan or coretemp.

i should probably look into updating the "bios" on this thing. anyway im crashing out. thanks for the quick responses.

Whether or not the UEFI causes that much or a load im not sure, but just to let you know whilst on the 1305 BIOS my temps in windows were 30/32c and BIOS showed high 40s. When I updated the BIOS to 1704 it made a huge difference to the BIOS temps, it went down as far as high 30s, it was much closer to the windows temp. I wouldn't worry much about the BIOS temp. Only thing you should concentrate on is the temps in windows, realtemp and coretemp do a fantastic job, there's others but those are only ones I recommend.

Get that waterblock on it and overclock that baby!!
