End of story, Like it or not. Take advantage of the rights that's given to you. Besides I think Intel would be a little less strict with their "K" SKU's knowing its unlocked. If your not going to overclock and worry about the company's wealth then buy the standard i5-2500 and stop whining like little baby's about RMA'ing a product when its clearly being provided as a right. THE END.
If he has the "right" to exchange it like you say then let him be honest about why he's returning it. You'll find your "rights" evaporate very quickly.
