Interplay was allowed to finish the Fallout MMO since it was copyrighted before Bethesda picked it up. Bethesda NEVER had any hand at making the FO MMO and probably never will.

He sent a response to them and they responded with a 15 page letter.

Granted I haven't read into great detail about this issue, I believe Bethesda is just pursuing this to show it's defending its trademark. If they didn't, they might lose it. Example: If someone comes out with a game with a very similar title, and Bethesda goes after them, those in question could claim Bethesda didn't ever try to defend their trade mark previously, and thus forfeited it.

I can see them trademarking the title "The Elder Scrolls", but the single word "scrolls", really? That's a bit silly IMHO, but whatever we'll see where this goes down the line.
