Please don't double post.

There going after apple because, two can play at that game. But recently apple has been playing the game the most. Dont get me wrong I have an iPhone, and it will be my last. I just don't like what they've brought to the table. 5 update and each one is a minor update, and they call it revolutionary. the galaxy s2 is, and apple is finally feeling the fire, and it turns out it burns.

I've heard Netherlands still offers the SGT 10.1, not sure.

But yeah, why was Apple granted permission to stop Galaxy Tab sales, even more so because of some design problem? As far as I know, no one's stopping those Chinese knockoffs that look almost like the iPad from selling, but somehow Samsung is caught in this mess and is now missing out on a very large potential market here. It seems that the competition is getting too close for comfort, that Apple is now deciding to outright block sales to stifle its rivals.

Bad move, more of your supporters are now losing interest because of your overly-aggressive actions.

Let's break this down, shall we?

Pictured here is the final design of the infringing tablet in question, the Samsung Galaxy Tab 10.1. Apple has complained about the SGT 10.1's design, which it claims to be copying the iPad.

Is it?

Hardware

- Screen size ratio is 16:10 (10.1 inches) on the SGT, 4:3 (8.9 inches) on the iPad 2.
- Resolution is 1280x800 WXGA on the SGT, 1024x768 XGA on the iPad 2.
- The rear on the SGT is made of plastic (eew), while the iPad 2 has an aluminum unibody.
- Rear camera module designs are different, as is their resolution (3MP vs. "HD" 0.7MP)

Software

- iPad 2 runs on iOS 4, the Galaxy Tab runs on Android 3.0/3.1 Honeycomb.
- Samsung's TouchWiz UX is still markedly different than iOS, even stock Honeycomb.
- Icons are NOT square-ish as in TouchWiz UI on Samsung phones, and the color scheme is more dark gray/purple/white.
- TouchWiz UX has mini-apps that act like widgets, none are present in HC or iOS.

Unless those patents are for very general terms, I'm not sure whether they are and I'm not on either Apple or Samsungs side (Fair enough for the looks, the Galaxy series look like Apple products, but not sure about the actual patents, if they're general then Apple should be stripped of them, if not then Samsung needs to innovate)

This patent should be stripped from Apple, there were many rectangular tablets way before the iPad.

This patent is ridiculous though.

If I patented a certain mix of chemicals that just happened to be the same mix as the atmosphere and then said "Everyone has to pay me to breathe", would that be fair? No, I certainly didn't invent it, but as you say, "A patent is a patent."

No company has the rights to abuse it, whether its Apple, Samsung, AMD, Intel (x86, much?), IBM, etc.

Yes, the Apple hate on OCN gets a bit much quite fast, but that doesn't mean every time someone hates on them that it's blind Apple hate, this is a fair enough issue, unlike say, the Mac Mini with no DVD drive thing.

I see a huge lack of business ethics here. They seem to be the only ones actively using it to curb already established competition.
Intel use the license to x86 to make sure AMD and VIA are the only competitors, and RAMBus anyone?

That's two examples, the entire patent system needs to be redone.

Except Apple was fine with Android for a few years, then when Android starts really competing with iOS and actually beating it? Wow, lawsuits all of a sudden!

Maybe its coincidental, but this patent at least? It's just a patent troll's patent.

Apple has made innovations, yes. I will never argue that Apple has never created an innovative product. No one can argue that their marketing is anything but top-notch.

However, iOS is extremely similar to Palm OS in many ways. The swipe-to-unlock screen was even an app for my Palm IIIe I had way back when PDAs were still black-and-white.

The tablet shape has been out for years, however Windows tablets were only used in specific business situations. They were just the first to take the simplicity of a cell phone, and simply enlarge it (ever seen an iPad taken apart?).

If I were to give Apple a broad credit for something, it would be that they are good at taking a product that tends to be only used by tech nerds and business men with specific needs, and bring it to the consumer in a very simplified, and attractive, package.

This patent lawsuit nonsense they are pulling... is 100% BS. You cannot patent something that has already been implemented. It's amazing to me that they won even a preliminary injunction.

They also waited too long to sue. If they were adamant about protecting their patent, they would have struck down the first attempts at emulating the iPhone/iPad. Instead, they waited until they were pressured by their competitors, and this is their defensive reaction to a falling market share.
This post pretty much describes the whole mess perfectly. +rep

A patent troll is a company that buys/makes patents that has something to do with their product, but are either already used extensively or are so vauge that they can be applied to what is used already.

This fits perfectly in that.

There is a right to doing that, yes, except Apple did not come up with the idea of a rectangular touch screen with a bezel, if you're trying to suggest that...Well, yeah.

None of these patents are valid due to prior art. I imagine that if Samsung has half a lawyer they can argue that the patent is too generic to be enforced.

This is like a fashion designer patenting a "style." Technology has a style, look at the evolution of computers. They went very quickly from utilitarian to basically accessories for your person or home. We will see these styles cycle just like we see clothing styles cycle.
This.

We're in a position to speculate at the very least, you're speculating that it's not an extremely general patent, we're speculating that it is.

And yeah, the system is messed up. Any company that plays the game should be punished for it, it wrecks competition and ends up hurting the consumers, no matter who does it.

This may be true, but to only sue once the competition takes you on and starts to win?

That is fair enough to rail on any company for, whether its Apple, Samsung, Google, IBM, etc.

If they have a patent for something that their products did and only did, fair enough, while I can't speak for most of OCN, I'd be like "Well, fair enough" but from what we've seen, the patent is very general.

The patent, if you're curious, is just a rectangular screen. And nothing more.

Samsung wasn't like 'oh poor customers, we can't sue X company, that will just limit innovation!', they were like 'Okay guys if we sue X, it'll cost us $X and we'll probably get $X. Not worth it. Oh and I tried to find a patent Apple kind of infringed to be able to sue them, but I didn't find anything, bummer. At least OCN will think we're good guys.'

Sure, this is bad for us customers, and I think this should not happen but portraying Apple as the patent devil is simply unfair and just another way for some of you to justify your hate.

Basically: I'm not saying we should just deal with it and congratulate Apple, I say you guys should stop trying to make Apple look worse than it does. Apple tries to maximize its profit just like every other single company is. You want nice companies that really care about us customers? forget about big corporations.

Apple uses the patents they have. Thus they aren't trolls. But hey screw reasoning, hating is funnier.
Neither Apple or Samsung should do it, nor Google, nor MS, etc.

Probably not.
That's true, they look a lot like each other.

But the patent is for any tablet pretty much...And there were tablets before the iPad that looked like the iPad, just less sleek.

And why is it only the Galaxy Tab? Because its successful?

That doesn't change the fact that the Tablet Patent is very general.

Also, IBM revolutionized the PC market with the IBM-PC, does that mean we should all only have IBM PCs? The gang of nine PC makers helped us with that, even though the ripped off the idea and actually just made clones. They didn't do anything other than have the 8088 at 8Mhz instead of 4.77Mhz, look at the industry now with all the innovation, etc. Can you argue that having manufacturers and competition is a bad thing?

You can only revolutionize so much, eventually it becomes the best it can be at that time for whatever job it does, I doubt we'll see a major revolution in smartphone and tablet design for a few years yet.
That said, Samsung is revolutionizing the hardware part of the smartphone market, 1.2Ghz dual core, 1GB RAM and a 4.2" screen that looks simply amazing, yet I get battery life better than my old 528Mhz single core, 192MB RAM and 3.2" screen HTC Dream? You can hardly say that's not revolutionary..And the sAMOLED screens? The software side (Touchwiz) is blatantly copying Apple though.

There's a complete difference to the average Apple hate (i.e. Nearly everyone posts "APPLE SUCKS" with a few people posting "Sigh, Apple Hate) and a decent enough thing to get angry about like this.

I see no physical similarities to the iPad other than it being slate style. Something that has become so generic among tablets that it cannot be patented.

If they have issues with the OS (which is where all the similarities tend to lie), they should probably take that up with Google, instead of suing only those who are gaining the largest share of the market.

What's even more interesting is that Samsung actually makes parts for Apple... Talk about biting the hand that feeds...
Don't waste your time, he's drunk to much of the apple koolaid.
