Other tablets have always existed, Apple just made them popular. Just like an example from a previous post: Ford popularized the automobile, so should every other car company have to pay for a license from Ford to make cars?

I think the take home message from all of this is that the patent office needs to rethink their criteria for handing out patents such as the one in question. Since apple holds this patent they are with in their legal right to defend it. If you have a problem with it, blame the people issuing the patents, not those who hold them and use them.

It is in any companies best interest to defend their patents, and if you had a company that held a generalized patent such as apple, I'm sure you'd be the first to make sure your money stayed your money. It's business people, and its ugly, live with it.

Just because you think it is invalid does not mean the court has thrown it out or invalidated the patent.


EDIT:
Also outside of the US (where this case is happening) first to file is used rather than first to invent, thus making Apple's patent valid internationally.
