Err, a lot of new phones and tablets look different from the iPhone/iPad aside from the presence of a slab of touchscreen. See the Motorola Droid, ASUS Transformer, Samsung Droid Charge and HTC Sensation.

I remember the LG Prada being out before the iPhone (as I was searching for a phone in early 2007) and it was primarily touch screen based and was shaped much like modern phones still are. Its not like Apple was the only one that had the idea of a phone controlled primarily by using a touch screen.

T-Mobile Sidekick 4G

Those phones are part of the Galaxy S series (save for the Nexus, Charge and Sidekick) and they don't look anywhere near the iPhone.

That's what the first Android protoype phone looked like back in 2007. Granted it's an HTC, but you're either naive or a fanboy to think that nobody has taken a few design cues from Apple.

It doesnt have to be the same company thats fighting their cases product to prove their was prior art which basically invalidates Apples patents, which is pretty much what todays court case has done bar photo swipey crappyness that wont be missed.
Basically most of their arty farty design patents got wiped out in the Netherlands today so sucess for Samsung.

^ I do agree that Android was changed in the last minute to combat iOS, but since its early beginnings it has carved its own identity through its subsequent updates. Similarities between Android and iOS are barely skin-deep, and even then Android offers more options in the UI department. Once you hit the system-level file system however, you will immediately note differences between the two operating systems; Android is a Linux fork, while iOS is based on Unix.

Those reasons justify that both platforms differ from one another.

As for the hardware, remember that the first Android phones look nothing like the iPhone in terms of form factor. Remember the HTC G1, Motorola Cliq and HTC Hero?








And even when platform has matured enough, the smartphone that put Android on the US Map - the Motorola Droid - looks nothing like the iPhone.
