The original claims by Apple regarding the Galaxy S were not related to the absolute measurements of the phone, but rather to the dimensional ratio--hence why they showed scaled drawings, to indicate a similarity to the iphone 4 design at a relatively high precision. It's well known that you cannot patent the size of something, so Apple couldn't practically use the absolute dimensions in a lawsuit to any extent anyway.

I'm not defending Apple, as I think they're taking all of this too far, but this "article" (and the alleged complaints by Samsung's lawyers) is stating irrelevant information in the context of the lawsuit.

This article, and the previous one regarding the ipad2 vs. tab, does not properly convey the information relevant to the accusations. Actual measurements were not in question, only the aspect ratio and how it relates to the functional design being nearly identical to Apple's iphone 4.

With that argument, I could also cite other devices such as the HTC Droid Incredible and HTC Desire for their near-similar dimensional ratio with the iPhone.

Apple is already pursuing litigation against HTC... http://www.idownloadblog.com/2011/07...hone-business/

It goes deeper than just the length, width, and height ratios--it goes more into the functional design of the phone being similar to the iphone4, also in terms of the OS/user interface, down to button sizes and layout. It gets to a point where one does not know where the issue lies--in the Samsung design, or the Android interface, because Apple claims issues that are interdependent between the hardware design and the OS design. Personally, I think it's pretty silly, but Apple appears to have the appropriate patents and IP to defend themselves, so we'll have to see what happens.

EDIT-- Could one simply just change the sizes of the rendered buttons in the UI, and bypass all of this "similar functionality" issue all together, or does it go even deeper than that?
