One of the worst 2500k's ever?

hi
OC'ing my 2500k is a pain! i cant even get 4.2ghz stable it seems, i say this because while playing ~BFBC2 my PC just crashes and requires a reboot, and once on boot up it said theres an issue posting due to overclocking.
i ran 4.5 at 1.37 and after 4 hours of prime my pc just restarted, no BSOD or anything!
i ran 4.4 at 1.37 and ran blend for an hour and got bored and played some BFBC2 and again it freezed, then on restart it kept on turning on then off making me have to clear cmos on the jumper as the auto-recovery thing didnt work. one thing which i found suspicious was that when i turned the PSU off, then back on the pc started itself going back into cycle as mentioned earlier.
i have followed Sin's great guide but my OC still seems to fail or crash during BFBC2
i have tried 4.3 at 1.34v-1.36v, not stable
what do you guys think the issue could be or is there something thats right under my nose but im missing it?
according to OCUK you shouldnt go above 1.38v and i know people say you can go higher but i would prefer not to, but if it was a voltage issue shouldnt i have like got a rounding error in prime during the 4.5ghz test as mentioned above?
could it be a fauly PSU?
i would really appreciate your help to help me get this OC'd

EDIT: i have also tested my RAM, seperately and they both passed 6 passes of memtest, latest version

defective chip? no idea seems like a lot of volts for such a low clock

whats your temps? could possibly be bad seat of heatsink and temps causing restart/bsod.

Wow, you must have gotten a really bad chip.

Nothing you can do about it really, you're only guaranteed to reach the stock clocks after all, anything above that is a gift from the transistor fabricating gods.

my highest temp on any core was 70 degrees celsius

right now BFBC2 just crashed at stock, think im going to email the company i bought it from and see what they say and see if i can get a replacement for it

Please try to disable C3/C6 stats in bios. Leave C1 alone.

They aren't going to replace it just because it doesn't overclock high enough...
