AMD Phenom II Stock CPU Fan problems?

Hello everyone, I've just built my new computer (The specs are in my profile) and it has started to act up now. It freezes randomly, reboots randomly and sometimes it doesn't even POST nor boot.

My Processor is an AMD Phenom II X4 965 Black Edition, and I use the stock cooler that came with it, and I read online that it's possible that the stock fan might be shorting my mobo. So, does any of you know anything about this subject?

I'm out of town as I'm writing this post, but I'm returning home tomorrow, and I think I'm going to unseat my CPU fan and take a look at both the CPU and the fan too see if any problems (bent pins etc.) are visible.

The weird thing I noticed with my computer is that it seems to be more likely to boot when it's laying on it's side rather than standing upright. This has led to me making the conclusion that it must be something with my CPU.

Also, on a side note, do I have to use thermal paste that is meant for CPUs, or can I use just any thermal paste I happen to find?

But, for now, I'd like it if anyone had anything touching this subject that could ease my mind. Could it be the fan? Could the CPU be broken? Also, if the CPU is broken, can I get a refund for it even though I've lost the original casing it came in? I mean, I bought the parts like 2 weeks ago, and there's atleast a 2 year warranty.

"more likely to boot when it's laying on it's side rather than standing upright"

This shows that most likely you haven't connected something properly. Check all plugs, check you've inserted the RAM and graphics card all the way, etc. Whoever said the CPU was shorting based on those symptoms must have smoked something bad. Still, there's a good thing to recheck if the CPU is seated properly and if the cooler sits as it should. Sicne it's your first time I recommend removeing the motherboard from the case and mount the CPU on the motherboard on a desk outside the case - this way you can see clearer what goes where.

cheers

Okay, thanks for the tips man. I'm gonna check the connections and the CPU seating tomorrow and post here if it fixes everything or doesn't do anything at all.

And yeah, I've written my problem to another tech forum and someone told me about the CPU fan shorting the mobo, and I thought that it could happen. But thanks for correcting that it can't.
