I, like the OP don't want to spend much over $200 especially since the new line of cards are coming out later this year.
I'm sure a 460 will play the game very well, but if you really wantnto max it out you might want to step up to the 560 ti, HD 6870, or just put a large OC on the 460 (yeilds~6870 performance). I should reiterate that we don't really know what the game will need, I would be very suprised is the 560 ti isn't enough; however, the 6870 could also be fine to max it out.

I may go with the 6870 I wanted to go with Nvidia but it seems AMD has a better card in my price range.

It really depends on what your acceptable minimum framerate is. For me its 60. And I don't think the 560 Tis going to cut it for BF3.
