it sounds like users complained about you trying to sell illegitemate MS points. You've seen this right? Someone sells points for a fraction of the cost, I don't know how they do it. Sounds like someone got a hold of your gamertag and password and used it to spam in this way. I hope you get it worked out

I would suggest calling and asking for a supervisor. Once on the phone with them, I would begin by asking kindly to review what he can about the case, be it times that they ban was put in place, relative to what you were doing then. Tell them that you are compiling as much information as they are able to share so that you can bring it to a lawyer in order to subpoena the missing information regarding your ban, and the loss of your investment ($500).

Then they are obviously unwilling to work with you. That's when you contact the BBB. Then the BBB will launch an investigation.

Then maybe, start off more aggressive. Ask for the name of who you should reference in terms of the subpoena or if you should make it vague against "Microsoft" as a whole?

Legal action should be viable in this case, and as such, that is the approach I would take.

Dont bother with the subpeona.
OP, just file a small claims suit. Its cheap, and M$ will get a summons to go to court. Be assured that M$ attorney fees are high enough that theyll contact you directly and will settle. Most likely refunding all of your money. Their attorneys have more important things to worry about.

The agreements for nearly all such services, including XBox live, PSN, Steam, and Origin, pretty much let them arbitrarily ban you and revoke all your licenses, with no real recourse.

I will never patronize these services, or buy any product that requires them. Even as unlikely as it is to encounter issues one does not bring upon one's self, the principle that I am just renting from them, on their terms and only their terms, is more than enough to keep me away.

Complaint Description:
Microsoft sent me an email stating that I have stolen Marketplace items on my Xbox live account, Djtomczak678, and they have issued a Permanent Ban from Xbox live services. I have not stolen ANY marketplace items but customer service seems to think they have evidence against me that they will not disclose. I have called them repeatedly and they always tell me to post a message on the support forums, which I have also done repeatedly. Yet they have not responded to me at all. They also have a message in their support forums that state they have clear evidence for all Marketplace theft bans and they will not respond of disclose any information regarding them. How do they have evidence if I have not stolen items? I have no idea how to do anything of the sort. I have been a member of Xbox live for over three years and I have spent at least 300$ on their services. I still had 5 months left on my current subscription that cost 60$.

Your Desired Resolution:
Either unbanning the Xbox live account Djtomczak678 or reimbursing me for my subscription left and all of the Marketplace items that I bought using Microsoft points that I have also bought from them.
