Its pretty much theft. You pay for something, they take it from you without giving you a reason why and tell you to get stuffed.
People need to stand up to this kind of thing... The more the consumers bend over and take it in the butt, the more the companies are going to do this.
Definately file that small claim, you should say you want to be reimbursed for the $300+ you spent on DLC along with the $60 of your subscription remaining. I wouldnt try and get your account unbanned, that would just give them grounds to say "its in the TOS!"
Ask for the reimbursement, and dont bother with your xbox live account again... Well, you could just buy it all over again, but if you got reimbursed thats money you could spend on pc hardware

I doubt the support line won't help you. On no occasion have they EVER told me to simply post in the forums for help, they are the direct line of help. I'm not sure you really called them. If you want to really get to the bottom of this you need to call them, and give them hell until they discover the problem. If indeed it was a wrongful ban.
